O colegiado destacou que somente a partir de mar\u00e7o de 2024 passou a ser obrigat\u00f3ria a motiva\u00e7\u00e3o formal para desligamentos em empresas p\u00fablicas e sociedades de economia mista, por decis\u00e3o do Supremo Tribunal Federal (STF).<\/p>\n<h4>Empregado alegou discrimina\u00e7\u00e3o<\/h4>\n<p>O caso teve in\u00edcio com a\u00e7\u00e3o ajuizada pelo agente, admitido em fevereiro de 2006 ap\u00f3s aprova\u00e7\u00e3o em concurso p\u00fablico em vaga destinada \u00e0 cota racial. O trabalhador alegou ter sido dispensado de forma irregular em maio do mesmo ano, ao fim do per\u00edodo de experi\u00eancia.&nbsp;<\/p>\n<p>Segundo ele, a banca de heteroidentifica\u00e7\u00e3o, sem especificar crit\u00e9rios, concluiu que ele n\u00e3o seria afrodescendente, ainda que tenha tra\u00e7os f\u00edsicos caracter\u00edsticos e seja neto de uma mulher negra. Nesse encontro, conforme seu relato, os integrantes da banca teriam deixado claro que a declara\u00e7\u00e3o prestada na inscri\u00e7\u00e3o para o concurso foi entendida por eles como falsa, e que seria demitido por isso.<\/p>\n<p>Na reclama\u00e7\u00e3o trabalhista, o agente sustentou que o desligamento teria sido discriminat\u00f3rio e pediu a reintegra\u00e7\u00e3o e indeniza\u00e7\u00e3o por danos materiais e morais.<\/p>\n<h4>Empresa apontou baixo rendimento<\/h4>\n<p>Em defesa, a Sanepar argumentou que o edital do concurso previa a dispensa por justa causa se fosse detectada a falsidade na declara\u00e7\u00e3o de afrodescend\u00eancia, mas que o agente foi dispensado sem justa causa dentro do per\u00edodo de experi\u00eancia. Segundo a empresa, o empregado n\u00e3o tinha estabilidade, e n\u00e3o havia obriga\u00e7\u00e3o de declarar a motiva\u00e7\u00e3o do desligamento.&nbsp;<\/p>\n<p>A estatal tamb\u00e9m apresentou uma avalia\u00e7\u00e3o do trabalhador em mar\u00e7o de 2006 que demonstrava que sua m\u00e9dia de trabalho estava abaixo da m\u00e9dia do restante do grupo em cinco dos nove itens avaliados.<\/p>\n<p>O Tribunal Regional do Trabalho da 9\u00aa Regi\u00e3o (PR) deferiu a reintegra\u00e7\u00e3o, por entender que, ainda que houvesse previs\u00e3o de contrato de experi\u00eancia, empregados admitidos por concurso p\u00fablico s\u00f3 poderiam ser desligados mediante motiva\u00e7\u00e3o. A decis\u00e3o foi mantida pela Segunda Turma do TST.<\/p>\n<p>Contra essa decis\u00e3o, a Sanepar apresentou embargos \u00e0 SDI-1.&nbsp;<\/p>\n<h4>Motiva\u00e7\u00e3o \u00e9 necess\u00e1ria somente ap\u00f3s decis\u00e3o do STF<\/h4>\n<p>O relator, ministro Breno Medeiros, destacou que o Supremo Tribunal Federal (STF), no julgamento do Tema 1.022 da repercuss\u00e3o geral, firmou entendimento de que empresas p\u00fablicas e sociedades de economia mista t\u00eam a obriga\u00e7\u00e3o de apresentar justificativa formal para a dispensa de empregados. Essa motiva\u00e7\u00e3o n\u00e3o precisa ser baseada em falta grave nem exige processo administrativo, bastando um motivo razo\u00e1vel e por escrito.<\/p>\n<p>Entretanto, o STF estabeleceu que a regra s\u00f3 vale para demiss\u00f5es realizadas a partir de 4 de mar\u00e7o de 2024, data da publica\u00e7\u00e3o do seu ac\u00f3rd\u00e3o.
